An encyclopedia, not a guidebook

I was hoping this book was a guide for the technologist, entrepreneur or small-company manager through the thicket of decisions required to protect intellectual property. This is not that book. Rather it is a 'desk reference' - more like a dictionary or encyclopedia than nitty-gritty advice on the patent process. However, as a desk reference it is a reliable source, having gone through 11 editions. It is part of the NOLO series of legal guides for non-attorneys and attorneys both. Probably the best use of the book is for someone who is already working with a patent attorney but wants to understand better what is going on. For example, if you run across the term "sovereign immunity" and want to know what that means, you will find it here. On the other hand if you want to know "How do I decide if my company really needs international filing," you will need to go elsewhere.

Everything You Need to Know, and More

One of the smartest things I ever did was take a class in contract law in college. It was horribly boring, but when I began selling books, I was able to understand publishing contracts and ask smart enough questions to really discuss points with my agent before agreeing to something a publisher wanted.

This is my twentieth year as a published author and Nolo Press's Patent, Copyright & Trademark: An Intellectual Property Desk Reference is even more important to me now than it would have been back before electronic rights stirred everything up. It's far more than I need, but good reference books usually are: it means I can find those obscure details easily and quickly.

With an excellent index and encyclopedia-style setup, it's easy to use and in a weird way, addictive. The book has four parts; Copyright Law, which is my sole interest at the moment, and equally large sections on patent, trademark and trade secret law. The sections each include definitions, forms, statutes and overviews that truly deliver. I find myself reading the definitions in my spare time, and looking up various things in the index as they pop into my brain: like why it's okay to quote a few words from some songs but not from others.

I'm giving the book five stars because I love it. It's not something you have to have, but it makes me feel more professional and smarter and now that I have it, I wouldn't want to be without it.

The Encyclopedia of Intellectual Property

Like all NOLO press books, the 11th Edition of "Patent, Copyright & Trademark: An Intellectual Property Desk Reference" is really more encyclopedia than just a mere reference. The 600+ pages of this book contain everything that you need to know regarding the registration, maintenance, and enforcement of your patent, copyright, trademark, or trade secrets (yes, it cover the Trade Secret Law as well). More than just a quick reference and book of forms (it definitely has those too!), this book delivers in depth coverage on all four of these forms of intellectual property protection available under U.S. law including a detailed definitions section where every bit of legal gobbledygook is explained in plain English and a section on the specific statutes that govern these legal devices.

If you are looking for a step-by-step how too, this book is not what you are looking for, but if you need that single reference book on protecting your intellectual property, this book from NOLO is the best option out there.

About the Author
Judy Swanson leads a not-for-profit research and evaluation firm, Research for Quality Schools, in Seattle, WA. For 20 years she has conducted research in urban schools throughout the US. Her expertise and recent research has focused on teacher leadership, professional development for instructional improvement, and teacher development at all stages of a teacher's career. She has worked with CSTP to develop and facilitate case writing retreats for teacher leaders since 2003. Swanson received her PhD in educational psychology at Stanford University.

For 19 years, Kimberly Elliott has written about P–16 education reform issues, raised funds to support innovative health and education projects, and developed curriculum materials. As The Word Mechanic, she currently helps clients such as The Center for Strengthening the Teaching Profession (CSTP), Education Development Center, Inc. (EDC), and the National Association for the Education of Young Children (NAEYC) create resources that promote changes in teacher practice and in educational systems to enhance student learning. She began her career at Wheelock College, where she helped advance the professional and leadership development of early childhood teachers. She has special expertise in writing for the Web and has contributed to online learning environments such as EDC’s Success at the Core leadership development website. A published author, she produces training guides, reports, articles, policy briefs, and white papers for early childhood educators, educators, and policy-makers and has edited books published by Jossey-Bass, Rowman-Littlefield, and Heinemann.

Jeanne Harmon is the founding Executive Director for the Center for Strengthening the Teaching Profession, an independent nonprofit organization focused on improving teaching quality in Washington State. Before launching CSTP in 2003, she managed the public-private partnership that created Washington’s statewide system of support for National Board Certification. CSTP develops leadership skills and promotes leadership opportunities for the state’s 5200 National Board Certified Teachers as well as hundreds of mentors and instructional coaches and other accomplished teachers across Washington. Previously, Jeanne taught elementary and middle school in Central Kitsap School District (Silverdale, WA), directed technology and professional development efforts there, and spent five years in the Northeast coordinating services to a network of 70 schools committed to math and science reform.

Teacher leader stories: The power of case methods. Swanson, Elliot and Harmon.

In education, teacher leadership is very topical and it has attracted such high profile writers as Harris & Muijs; Gabriel; Lieberman & Miller; Kaagan & Hann; Katzenmeyer & Moller; and Joseph Murphy. Teachers' Unions, too, have an ideological and industrial commitment to this concept also. At the school level, every principal would benefit from both teacher leadership, and a corresponding teacher followership in a variety of situations.

Case study methods have been used successfully in high profile business programs at Harvard (Ellet, 2007) and this book represents an historic step forward in teachers' professional learning. While case studies might have been used in teacher professional learning, Swanson, Elliot and Harmon's book pegs out a vital claim.

The first and last word in finding free art and music

Highly recommended! I'm an artist and musician and I've been waiting for a book like this for years. It's like a road map that lets you figure out what stuff you can use without permission (and without having to ask a lawyer if its okay). And there is a lot of free art out there ... not just old stuff but U.S. government art, etc. It's a very sharp, well-written book with lots of interesting trivia, too.

An incredibly wonderful and useful book!!!!

As a writer of musical theatre, I am constantly brainstorming for new ideas and thinking about what works may be in the public domain to use. Finally there is a book that removes so much of the guess work. Stephen Fishman has written a book that is very "user friendly" and incredibly helpful. He gives all the important facts, and describes how to do your own research on copyright status (to avoid those heavy fees the goverment office charges!). It is also full of interesting sidebars, mini-charts of famous public domain works, tips, advice....everything you could ask for. I find myself just picking it up to flip through for fun....and now I practically I feel like an expert on the subject! In summary, this book is a must have!

Another great NOLO publication!

NOLO writes legal books for the rest of us. I've used other NOLO books and gave this one a shot. I found this book to be a wonderful guide to the whole subject of public domain, from where to find it to how to use it effectively. It was also a great introduction to the history of public domain and its significance in the legal landscape of intellectual property. it's a great resourse for anyone that needs creative content for free!

a true to life story that is wonderfully written

I purchased this book as soon as it was published because I have read the Princess books by Jean Sasson and already knew that she was an editorial genius. This book is about the title-character, Mayada. Mayada came from a prominent Iraqi family and she owned and managed a printing shop. Tragically under the harsh rule of Saddam Hussein she was accused of breaking the law and thrown in jail. Mayada's basic human rights were violated while she was in jail. She met several women in her jail cell, the "shadow women" as they are called. The shadow women are all so brave and harrowing. Each shadow woman has her own story of despair; one worse than the next. The fate of the shadow women is unknown, but if you read this book you will find out what happens to Mayada. "Mayada" is among Ms. Sasson's best work. It is thought-provoking, intense and written in great detail. It is my sincere hope that Ms. Sasson will write a follow-up story this.

I like your text because it emphasizes examining your own thinking instead of only pointing out holes in the thinking of others."

A qualified success

I have taught with the sixth and seventh editions of this book since late 2003.

Generally, Mayfield does well discussing fallacies. Exceptions are noted below. She also does well describing the range of political viewpoints in America. This is important because many students are unaware of the range of political opinion in America.

The text pays much attention to the nature of observation and the relation between sensation, perception, and thought. A fair number of black-and-white illustrations are provided as subjects for detailed visual analysis. Students interested in the visual arts may like this.

The author refers somewhat too much to historical injustices against Native Americans. Native Americans have genuine grievances and some of the material is interesting, but students have expressed irritation at all the harping on the same tune.

The following comments identify errors of fact or incongruities that get in the way of teaching and learning. Some errors have persisted in two or more editions. It's true that one can make pedagogical opportunities of them, but that's no excuse for the author. Page numbers refer to the seventh edition.

Page 4, blue inset: the word 'skeri' is not an Anglo-Saxon word but a Proto-Indo-European root. 'Skeri' is the root of Greek 'kriterion,' which is the root of the English 'critical.' The text, then, is both inaccurate and unclear about the sequence of derivations.

Page 175: The author recognizes that an evaluation--Chapter 7--is a kind of opinion--Chapter 6. Separate chapters might be justified if each chapter had more meat, but they have little. They emphasize that the worth of an opinion/evaluation depends on the authority and motives of the person giving it, and that one's right to one's opinion does not mean that one's opinion is worth anything. I advise teachers to cover these two chapters in one class meeting.

Page 208: The quoted passage is probably not by Alexander Henry, for these reasons: 1. The use of the past tense clearly implies that the Native American nations are no longer are a significant presence. They were, however, significant and powerful in the colonial period, when the passage was allegedly written. 2. The style does not at all resemble that of other works attributed to Henry, which are extensively available on the Internet. 3. Most tellingly, the passage reads like 20th century English. Alexander Henry died in the 1820s.

Page 298: The directions for Part 1 of the chapter quiz use the term 'misapplied euphemisms,' but elsewhere in the text the term is 'misleading euphemisms'--confusing.

Page 299: Item 8 in Part 1 belongs elsewhere. The statement "There is virtually no tar in these cigarettes" is not a "misleading euphemism," "bandwagon," or "appeal to fear" fallacy. It's an example of vague or ambiguous language--'weasel wording'. The same is true of item 11.

Page 345, Item 11: Is this a ringer, or what? You can't say the passage is "nonfallacious." You can say that it demonstrates the "either-or fallacy," but that misses the point, doesn't it? A bright class might appreciate Woody Allen's gag, but it's a distraction from the exercise.

If this is the only book available, a teacher can use it to put together a viable course in critical thinking. However, I advise looking further.

It's critical to think when we think

Bought this for a critical thinking class for college a few years ago. There are probably newer versions out now. Critical thinking was the most useful class/subject studied throughout college. It should be required in high school, so teenagers and aspiring adults can think and argue more rationally. Granted, priorities and what one pays attention to or retains knowledge of often changes with age/experience, and being 30-something, this subject seemed to hold more value for me than for younger folks in the class; developing logic and sound reasoning is still vital for anyone wanting to intellectually grow up regardless of his/her biological age. This book was very easy to follow and understand. Mayfield does a good job at presenting the information. Would recommend. Thanks.

This is a practical, well-organized manual for how to be a good landlord and avoid some of the pitfalls of owning rental property. Sample leases and rental agreements, information about liability, discrimination, repairs, and maintenance, and how to deal with problem tenants fairly and legally are all contained in here. Maybe if more landlords read this book, more tenants would feel like they and the owner are not intrinsic adversaries. Even though we get along quite well, and have for the last 22 years, I lent my copy to my landlord--for the other tenants' sakes!

If you own in New York or California you will want to buy the editions specific for those states. I live in California and almost goofed and bought this edition.

If you can only purchase one book about rental properties, get this one! It is well-written, well-organized, and worth the price. I purchased this book at a point of peak frustration after making some costly and discouraging rental mistakes. This book has been immensely helpful in turning things around for me; it has saved me time, money, and headaches.
As a beginning landlord, I cannot recommend this book highly enough!!

The best landlord book bar-none!

This is the only book you need! It is incredibly easy to use and covers everything from rental agreements, to liability and discrimination, to maintenance, to evictions. It really leaves nothing out. The best part is the included CD-ROM which has all of the forms you'll need in an easy-to-fill-in format.
I own five properties and thanks to Every Landlord's Legal Guide I have learned how to legally protect myself and have consequently avoided countless expensive lawsuits. This book could end up saving you thousands!
