About the Author
Stephen R. Elias is an attorney and former associate publisher at Nolo, as well as current President of the National Bankruptcy Law Project. He is the author of many Nolo books, including recently The New Bankruptcy. Other titles include Special Needs Trusts and How to File for Chapter 7 Bankruptcy. He is also one of the original authors/designers of Nolo's bestselling WillMaker software. Steve holds a law degree from Hastings College of Law and was a practicing attorney in California, New York and Vermont before joining Nolo. He has been featured in such major media as The New York Times, The Wall Street Journal, Newsweek, Good Morning America, 20/20, Money magazine, and more.

Bethany K. Laurence joined Nolo as a legal editor in 1997. She holds a law degree from University of California, Hastings College of the Law, a B.A. degree from Boston University (Phi Beta Kappa, magna cum laude), and is a member of the California State Bar. Laurence has combined her legal and financial expertise to edit many Nolo small business books over the years. She is the co-author of Business Buyout Agreements: A Step-by-Step Guide for Co-Owners. another excellent NOLO book you can count on.

NOLO has been a reliable source of legal resource books for about 40 years, and they can save you thousands in legal fees. This book is no exception, and if you are a small business owner even considering bankruptcy, this book will help you evaluate your situation and determine which path to follow. Particularly helpful is is that it brings your personal financial situation into the picture, including what happens to your home if your business goes bankrupt.

It is really helpful that all the necessary forms are included, in tear-out sheets, but the only negative for this otherwise-excellent book is that it does not come with a CD containing all the forms like many of the other NOLO books do. I usually like to have the forms in the book for reference, but also to have them on a CD so I can customize them, fill them out, and print them all ready to submit. Also, it is a pain to have to either hand-write or type on forms (who does that anymore? ;) ) and I would much rather be able to fill out all the forms on the computer instead. Not including a CD with all the forms is why I gave it 4 stars instead of 5. But it is still an exceptional resource you can use to sort out your personal and business finances, find out how bankruptcy works, fill out the appropriate worksheets and prepare the necessary forms for filing. In addition, the Appendix includes information for individual state and federal exemptions.

The assistance from this book doesn't end there, though. It also details how to handle your case in court and then how to deal with the aftermath of bankruptcy.

All in all, another reliable NOLO book, with up-to-date 2010 information and forms, and detailed legal information to assist you with the difficult, costly, and stressful process of bankruptcy.

I would definitely recommend this book, even if you are dealing with an attorney already. That way you can educate yourself and understand the bankruptcy process, to better protect yourself, and what's left of your money.

More than just Chapter 7

What I really liked about this book is that it offers advice on business bankruptcies in general, not just chapter 7. It has clear comparisons on when chapter 11 or 13 are the better choice, with corresponding eligibility and drawbacks. It also includes liability on a business owner's house. It has 2010 updated information and (as it's usual with NOLO publications) any new changes in law are reflected on the web-sites provided. Please note - this book is primarily geared towards bankruptcy for small business owners. NOLO also has a Bankruptcy Chapter 7 book for individuals, How to File for Chapter 7 Bankruptcy, so choose appropriately.

Not for the faint of heart

If you are seriously reading this book, accept my sympathies. When I ordered it I too was on the brink, and reading through it has convinced me to try any other way I can to resolve my current financial situation. While with typical NOLO thoroughness,(with the unfortunate lack of the ubiquitous CD) it details every procedure, answers nearly every question and provides forms galore to help you proceed through this process yourself, should you choose. I still feel it is a course of action not to be taken lightly or without the help of an attorney, But you will also find the advice and examples presented in this book invaluable in understanding the process and help you by being far more better prepared when the time comes.

About the Author
John N. Gardner brings unparalleled experience to this writing partnership for American higher education's authoritative text for first-year seminar courses. He is the recipient of his institution's highest award for teaching excellence. He has 25 years of experience directing and teaching in the most respected and widely emulated first-year seminar in the U.S., the University 101 course at the University of South Carolina. Gardner is universally recognized as one of the country's leading higher educators for his role in initiating and orchestrating an international reform movement to improve the beginning college experience, a concept he coined as "the first-year experience." He is the founding executive director of two very influential higher education centers which support campuses in their efforts to improve the learning and retention of beginning college students: the National Resource Center for The First-Year Experience and Students in Transition at the University of South Carolina (www.sc.edu/fye), and the Policy Center on the First Year of College in Brevard, N.C. Jerome Jewler is a best-selling author, educator, and friend to students. She also taught University 101 and graduate courses on the first-year experience and the principles of college teaching. She conducts first-year seminar faculty training workshops around the world and is frequently called on to evaluate first-year seminar outcomes. Betsy is codirector and senior scholar in the Policy Center on the First Year of College in Brevard, North Carolina, where she led a major national research project to identify "institutions of excellence" in the first college year.

Richard Allen is an international consultant with more than 25 years experience coaching trainers and educators. Cofounder and president of Education Illustrated, he has taken the TrainSmart strategies beyond the United States and Canada to such diverse countries as the United Kingdom, Australia, New Zealand, Hong Kong, Singapore, Brunei, Russia, Jordan, and Brazil. Allen is also a popular keynote speaker at international conferences, and he facilitates motivational and teambuilding workshops.

Allen started his educational career as a high school math and drama teacher. In 1985, he became a lead facilitator for SuperCamp―an accelerated learning program for teens―and has since worked with more than 25,000 students worldwide. He completed his doctorate in educational psychology at Arizona State University, where he studied how the human brain receives, processes, and recalls information―knowledge that informs all aspects of his training strategies.

Jenn Currie has been teaching in the Commodore Perry School District for over 15 years, working largely with adolescents in grades 4 – 6. Since discovering brain-based learning strategies in 2005, Jenn has consistently helped ‘problem’ students achieve their first-ever academic successes. Her work has been recognized formally, as Teacher of the Year in 2008 and 2010, and informally through numerous letters from her students, their parents and administrators.

After seeing powerful results in her own classroom, Jenn has become a staunch advocate of supporting student success through best practices and brain research. She has taken an increased role in professional development: facilitating workshops for parents, mentoring beginning teachers, leading professional study groups, as well as running in-service trainings at various school districts, universities and state conferences. Since 2009, she has led a continuing education course entitled, “The Winning Combination: Linking Brain Research with Practical Classroom Strategies”.

Jenn earned her B.S. and M. Ed in Elementary Education from Slippery Rock University of Pennsylvania, and is currently pursuing a doctoral program in Teaching and Learning. Despite having taught for nearly two decades, she continues to delight in the challenge of showing every student that they can succeed.

Along with her husband Scott and their canine companion Maggie, Jenn lives in the small, rural town of Greenville, Pennsylvania. Together, they enjoy cooking and spending time in the great outdoors hiking, four-wheeling, and horseback riding. She may be reached at jenncurrie@verizon.net.

This is a great book! I gave it to a new teacher as a gift, and she has "wowed" her administrators with the strategies that she has used from it. She will be a much stronger teacher thanks to the knowledge and insight she has learned from these authors!

About the Author
Roderic Duncan was appointed to the California Municipal Court in 1975, and he was elected to the California Superior Court bench in 1987. Over the years, he has been a lecturer and faculty member at two dozen educational programs for judges. In 1990, he was chosen the Judicial Officer of the Year by the California State Bar, Family Law Section. Since retiring from the bench in 1995, he has been doing private judging and mediation.

Nice for beginners, but

I was hoping that this book would be in depth and go into the details of family law because it was written by a judge. Instead, it told me what I knew and tried to avoid. That going through the legal system is the wrong thing to do. While I did get one or two insights out of the book, it tries to be all things to all people, covering all 50 states and avoiding anything too technical.

So if you are jurisdiction shopping or trying to figure out whether to do mediation or go to court, this may be the book for you. If you are deep into the legal stuff already and want some insight and guidance, keep looking.

When Eperienced Judges Talk About Divorce ---- Listen up!

After reading Judge Roderic Duncan's book, I was compelled to track him down by phone just to thank him for a book that needed to be written. While mothers, fathers, lawyers, mediators, collaborative professionals, counselors and mental health providers all have varied opinions about what divorcing couples should and should not do, it is easy to forget that in court only "One Person's" opinion really matters.

When such a qualified and well respected judge shares all, in such a frank and candid manner, you know you are in for a good read. I think that the tone of the book is set out well in the foreword where Judge Duncan states: The disturbing thing that I learned as a divorce court judge is that most people getting divorced know very little about the legal side of the process that often controls their finances, the custody of their children, and the ownership of their homes, their automobiles, and their investments. And very many of these people - some represented by lawyers, some not -- stumble through the divorce maze, making mistakes that cause the process to be more expensive, time-consuming, and painful than it need be. Not surprisingly, most come away unhappy with their experience."

As a family law attorney, mediator, collaborative lawyer and author of Stop Fighting Over the Kids: Resolving Day-to-Day Custody Conflict in Divorce Situations, I can certainly attest to those observations. One message from A Judge's Guide to Divorce: Uncommon Advice from the Bench is that you really "win" your case by avoiding contested litigation except as a true last resort. Since well over 90 percent of contested cases settle before trial, usually right before trial, why is all the nonsense leading up to trial necessary. Furthermore, when children are involved, it sure isn't over after court. Post-divorce conflict is far more likely in cases that actually go to trial then in cases where there has been an amicable, or at least acceptable, resolution well in advance of trial.

While the book is replete with excellent legal guidance, the chapters that I found most meaningful where "Stay Out of Court if You Can" "Consider Alternatives to Divorce Court" "Settle Child Custody and Visitation Issues Sanely" "Get on with Your Life" and perhaps most importantly, in my humble opinion, was the chapter, "Don't Get Hung Up on Fairness." What great advice! Although it may sound ironic coming from a judge, the sooner people realize that cases are not decided on ones's subjective views of "fairness," the better prepared they may be to explore alternative dispute resolution methods such as mediation and collaborative law.

Another thing that Judge Duncan reminds us is that Judges are people too. They make mistakes and many of them dread being assigned to family court. Use this book as an overview only !!!

I am rewriting the short and naiive review I originally posted here. I am in mid-process of working a K-1 Fiance Visa and I want to make it clear that this book is nothing more than an OVERVIEW of what you will go through to do this. The procedures and requirements change constantly, as well as the forms. I know the author of this book has great knowledge of the process, but you simply cannot print something on a volatile subject like immigration and expect it to still be valid the next year.

The book IS well-written and fairly easy to understand, but therein lies the caveat. It certainly lulled me into a sense of simplicity and I did not prepare much of what was needed until the very week I had planned to submit the initial petition form. There is MUCH required and it takes intense study and preparation.

I'd say, if you are planning to do any of the things this book covers, buy it or look for it at the library. BUT please please please find the Visa Journey website very early in your preparation. Visa Journey is an organization of people just like you and me, who are attempting or have already succeeded or failed to win a Visa for themselves or someone else. There is so much information on this site that it will take many many hours to satisfy yourself that you've seen it all and are ready to begin your process.

Comprehensive A to Z Guide to Immigration - But Not Good Enough

Update: Now that I have finally finished getting my fiancee here from the Philippines, I can say that this book is basically somewhat useful. However, it is not good enough to be successful with this book alone. Although this is a thick book with lots of forms and examples, it is actually too generalized and tries to cover every possible scenario. In doing so, the layout is confusing and inadequate for any specific case. My situation was very straightforward. I am widowed and my fiancee has never been married and never had any children. I have two children who are fully grown. So I don't think my situation could be any simpler. Thankfully I hired a consultant and even he wasn't really up to date on everything. A fiancee visa is too long a process to make even the slightest of mistakes or you could end up starting over. There are just too many details that are completely missing in this book - things like the medical exam and how to properly prepare for the make it or break it embassy interview.

From the day that my fiancee visa was received by the Department of Homeland security until the day she arrived was exactly 40 weeks to the day. There was not a single day of delay. It just takes a long time to get processed. If I had depended solely on this book, I think I would still be waiting for the K1 visa to be approved. You can try to do this cheaply and you might be successful, but I strongly believe most people would end up making too many mistakes and providing inadequate information and mess up their application. A USA based consultant will cost about $1000 to get you from the beginning through the Adjustment of Status phase. I am just about at the point of getting married now. The paperwork for the Adjustment of Status is even more than the fiancee visa. And even if the K1 visa forms are perfect, it does not guarantee you that your fiancee can get a permanent visa or green card. We have another two years to go before her temporary visa can become a permanent visa. From the time we met on-line until that future date will be about four years. I met her 1.75 years ago.

When this arrived in the mail, I was almost shocked to find a 480 page book on Fiancée and Marriage Visas! I've been trying to find material on this subject for over a year and now realize that this book has everything and more in one highly organized and informative book. It contains lots of sample forms and actually filled out with example information - not just blank forms. You can click on the table of contents to determine how exhaustive this book is on the subject. It also contains a list of example questions asked during the interview process. I think most people getting married here in the United States would fail the interview process. Who would know the color of your spouse's pajamas or what kind of toothpaste your spouse uses? You would think you've already been married for several years from this list of interview questions. I don't know how anyone would pass the interview without knowledge of these questions ahead of time. But they also include a section on what to do if the interview goes badly. And the book also explains how to get the green card and things you need to know to avoid getting deported like failing to change your address with the USCIS if you move. It also names resources to find a competent lawyer and the types to avoid. I haven't had this book long enough to read it in entirety, but I have read enough to know this book is definitely something everybody should own if they are serious about bringing a person to the United States from another country. The cover is in color, but the entire book is black and white text. However, the way the information is presented makes it easy to read and digest. It is actually interesting to read if only just to learn about the process.

Incredible resource

I am happy to report that we are approved. Immigration seems like an obstacle that is too big to overcome. My boyfriend and I were miserable living in two different countries. He proposed and we consulted a lawyer. With a little input from them, and a cost estimate of what it would cost for them to help, we decided to buy the book and figure it out ourselves.

I am so glad I understood the process before we went through it. We were able to figure out where to get married, how to file, how long he would be without a job, etc. We turned our application in in July. Received his work permit 2 months later, and had our appointment and approval within 4 months from turning in our application.

Anyone who is engaged or involved in an overseas relationship considering a true future should buy this book. Getting all the forms in order was by no means a simple process, but with a lot of dedication and this book to guide you- it is possible to do this without a lawyer.

Long distance relationships can work :)

About the Author

Luanna H. Meyer is professor of education (research) and director of the Jessie Hetherington Center for Educational Research at Victoria University in New Zealand. She is also emeritus professor at Syracuse University in the U.S. and adjunct professor at Griffith University in Australia. Since receiving her PhD from Indiana University, she held faculty positions at the University of Hawai’i, the University of Minnesota, Syracuse University, and Massey University prior to her current position. While at Syracuse University, she co-founded the Inclusive Elementary and Special Education Teacher Education Program and coordinated the doctoral program in special education. She also led numerous federally funded research and development projects, including a five-year research institute on the social relationships of children and youth with diverse abilities and the ten-year New York Partnership for State-wide Systems Change.

Throughout her career as a teacher educator and educational researcher, Luanna has been committed to developing practical, evidence-based approaches that can be implemented in real life, typical situations and settings. She works closely with school leaders, teachers, and behavior specialists towards achieving inclusive schools where all children and youth belong and feel valued. Her contributions to the development of positive approaches to behavior problems are acknowledged by her appointment to the Technical Review Committee on Behavior for the National Center for Students with Disabilities who Require Intensive Interventions led by the American Institutes for Research. She was among the first to demonstrate that even the most severe behaviour can be managed with positive approaches, supported by her published research conducted in typical settings with children with severe behaviour disorders, autism, and other disabilities. In New Zealand, her current federally funded projects include research on culturally responsive behavioral intervention in schools; culturally responsive pedagogies for teachers; effective school-based behavioral intervention practices; and the impact of assessment design on student motivation and achievement in secondary schools across the curriculum. A major focus of this work is on effective policy and practice to meet the needs of an increasingly diverse regular education school community.

Luanna has been invited to speak in eight countries and 30 US states about her work, and she has published more than 120 journal articles and book chapters. Her 12 books include Making Friends: The Influences of Culture and Development, Critical Issues in the Lives of People with Severe Disabilities; Behavioral Intervention: Principles, models, and Practices; The Syracuse Community-Referenced Curriculum Guide; Non-Aversive Intervention for Behavior Problems: A Manual for Home and Community; and An Educative Approach to Behavior Problems: A Practical Decision Model.

Ian M. Evans is Professor of Psychology at Massey University in New Zealand. After his PhD at the University of London’s Institute of Psychiatry, he taught behavior assessment and therapy for many years at the University of Hawai’i while also serving as consultant psychologist to specialized programs for children and adults with very complex developmental needs. He founded the Hawai’i Association for Autistic Children and was appointed Commissioner on the Governor’s State Planning and Advisory Council for Developmental Disabilities. At this time, he and Luanna Meyer began their collaborative work in the public schools across the state, funded by a federal research grant on children’s challenging behavior. They have published together on learning and behavior, including major meta-analyses on effective interventions and the earliest practical books on behavior problems for use by teachers and practitioners entitled Non-Aversive Intervention for Behavior Problems and an Educative Approach to Behavior Problems.

After becoming Director of Clinical Psychology Training at SUNY-Binghamton, Ian continued his focus on disabilities as well as leading the Binghamton Liberty Partnership Project. This intervention research was funded by state and federal grants to work with elementary schools in preventing school dropout using a home-visitor model to enhance teacher-parent communication. His book Staying in School: Partnerships for Educational Change reports this work and that of colleagues across New York State evaluating initiatives in regular education to support children, families, and the schools. Since moving to New Zealand in 1995, he has been professor, clinical program director, and department head at the University of Waikato and then Massey University. He also served as President of the New Zealand Psychological Society. His most recent work is teacher-focused to enhance the emotional atmosphere in elementary school classrooms, which has led to publication of a manual and a series of research reports. His life-long commitment to children with autism and their families has been recognized by honors including Life Member of the advocacy group Parent-to-Parent and chairing the government’s Living Guidelines Group of the New Zealand Guidelines for Autistic Spectrum Disorder.

Ian has published 6 books, 54 book chapters, and over 100 refereed journal articles, and he serves on the editorial boards of 5 international journals. He is a Fellow of the American Psychological Association and a Fellow of the Royal Society of New Zealand. His other interests include photography, antiques of the Arts and Crafts period, taking long non-strenuous walks, wine tasting, and watching his grandchildren develop.

Good text, but a little repetitive. Some of the concepts are repeated over and over. Overall it is a helpful book.
